These Terms of Service ("Terms") govern your participation in the SMS notification program operated by Mortar Metrics Inc. ("Mortar Metrics," "we," "our," or "us"), a marketing and consultation firm with a principal place of business at 25 Trent Ave, Toronto, Ontario M4C 5C6. By opting in to receive text messages from us, you agree to these Terms in full. Please read them carefully before opting in.

Program Description

Mortar Metrics Inc. operates an SMS notification program to keep clients and prospective clients informed about matters directly related to their account and service engagement with the firm. This is a non-marketing communications program. All messages sent through this program are informational and transactional in nature, including consultation reminders, onboarding updates, account status notifications, and campaign-related communications. No promotional or advertising messages are sent through this program.

Eligibility

To participate in our SMS program, you must be at least 18 years of age, possess a valid mobile phone number capable of receiving SMS messages, and have provided your express written consent by voluntarily checking the opt-in checkbox on our consent form. By participating, you confirm you are the authorized account holder for the mobile number provided.

Opt-In Process

You opt in to the Mortar Metrics SMS program by visiting our consent form at mortarmetrics.com, providing your contact information, and voluntarily checking the non-marketing SMS consent checkbox. The checkbox is never pre-checked and is not required to submit the form. Declining to opt in will not affect your access to our services. Upon opting in, you will receive a one-time confirmation SMS acknowledging your subscription.

SMS Messaging Terms

Mortar Metrics Inc.

Mortar Metrics Inc. provides text messaging services to keep you informed about your appointments, service progress, and important project updates.

Message Types: When you opt in to receive text messages from us, you may receive:

  • Appointment confirmations for consultations and strategy sessions

  • Appointment reminders for scheduled meetings and calls

  • Service reports on CRM performance, automation metrics, and campaign results

  • Project proposals for new services or system enhancements

  • System notifications about important updates or required actions

  • Technical support responses and troubleshooting updates

Opt-Out Instructions: You can cancel the SMS service at any time by texting "STOP" to 639-399-4802. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.

Message and Data Rates: As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your service level and project activity. Mortar Metrics Inc. provides marketing technology services to businesses. Our services include but are not limited to:

  • Customer Relationship Management (CRM) system setup and configuration

  • AI voice caller service implementation and management

  • Marketing and sales automation workflow development

  • Integration services with third-party platforms and tools

  • Technical support and system optimization

  • Training and consultation on marketing technology

Scope of Services

The services we provide are based on your business requirements and the scope outlined in our service agreement. You are responsible for providing complete, accurate, and timely information about your business needs, existing systems, and desired outcomes.

We work to deliver high-quality technical solutions but cannot guarantee specific business results such as increased sales, lead generation, or revenue growth. Marketing outcomes depend on multiple factors beyond our technical implementation.

Our services do not constitute legal, financial, or business consulting advice. For matters related to compliance, regulations, or business strategy, you should consult with qualified professionals in those fields.

Fees and Payment

Fees for our services will be outlined in our service agreement or proposal. Payment terms, project scope, and deliverables will be clearly defined before work begins. Payment is typically due according to the payment schedule specified in your agreement.

Late payments may be subject to interest charges and suspension of services. We reserve the right to withhold access to systems or deliverables until payment is received in full.

Client Responsibilities

As a client of Mortar Metrics Inc., you agree to:

  • Provide complete and accurate information necessary for service delivery

  • Grant necessary access to systems, platforms, and accounts required for implementation

  • Respond promptly to requests for information, feedback, or approvals

  • Maintain the security of login credentials and API keys we provide

  • Comply with the terms of service of third-party platforms we integrate with

  • Notify us immediately of any issues, concerns, or changes to your requirements

Intellectual Property

All custom work, configurations, automations, and deliverables created by Mortar Metrics Inc. for your specific project become your property upon full payment, unless otherwise specified in our service agreement.

Mortar Metrics Inc. retains ownership of our proprietary tools, templates, frameworks, and methodologies used in delivering services. We reserve the right to reuse general solutions and approaches in work for other clients.

Confidentiality

We maintain strict confidentiality of all client information in accordance with professional standards and legal requirements. We will not disclose your information to third parties except as required by law, necessary to deliver services, or with your explicit consent.

You agree to maintain confidentiality of any proprietary information, tools, or methodologies we share with you during the service relationship.

Service Limitations

We strive to provide reliable services, but we cannot guarantee uninterrupted access to third-party platforms, APIs, or integrated systems. Service disruptions due to third-party downtime, API changes, or platform updates are beyond our control.

We are not responsible for data loss, system failures, or issues arising from third-party platform changes, user error, or circumstances beyond our reasonable control.

Electronic Communications

By providing your email address and phone number, you consent to receive electronic communications from us, including emails and text messages. These communications may include service-related updates, appointment reminders, and important system notifications.

Limitation of Liability

To the fullest extent permitted by law, Mortar Metrics Inc. and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services.

Our total liability for any claims arising from our services shall not exceed the total fees paid by you for the specific services giving rise to the claim during the twelve (12) months preceding the claim.

Termination

Either party may terminate the service relationship in accordance with the terms of our service agreement. Upon termination, you are responsible for payment of all fees for services rendered up to the date of termination.

We reserve the right to terminate services immediately if you breach these Terms of Service, engage in fraudulent activity, or use our services for illegal purposes.

Governing Law

These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising from these terms or our services shall be resolved in the courts of Ontario, Canada.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Age Requirement

Our services are intended for businesses and individuals who are 18 years of age or older. By using our services, you represent and warrant that you are at least 18 years old. We do not knowingly provide services to individuals under the age of 18. If you are under 18, you may only use our services with the involvement and consent of a parent or legal guardian.
